Terms & Conditions of Sale

These Terms & Conditions govern all sales of knives and related products by T Rose Knives. By placing an order, submitting payment, or accepting delivery of a product, the buyer agrees to the following terms.

1. AGE REQUIREMENT
The buyer must be 18 years of age or older to purchase a knife from T Rose Knives.
Before completing checkout, the buyer must affirmatively confirm – by checking the confirmation box presented on the order page, as described in Section 13 – that they meet the applicable legal age requirement and are legally permitted to purchase and possess the knife in their jurisdiction. This confirmation, and the date and time it was given, is retained as part of the order record.
T Rose Knives reserves the right to request proof of age and to refuse or cancel any order when age cannot be verified.

2. LEGAL COMPLIANCE
The buyer is solely responsible for knowing and complying with all federal, state, and local laws regarding the purchase, possession, carrying, transportation, and use of knives.
T Rose Knives does not represent that any particular knife is legal to purchase, possess, carry, or use in the buyer’s location.

3. CUSTOM ORDERS
Custom knives are made specifically to the buyer’s specifications. Because these products are individually made, custom orders may not be canceled, returned, or exchanged once production has begun. For purposes of these Terms & Conditions, production is considered to have begun once material has been cut, machined, or otherwise committed to the buyer’s specific order (“Production Start”).
After Production Start, a custom order will be canceled, returned, or exchanged only where required by applicable law, or where the knife does not conform to the buyer’s approved specifications or to the warranty in Section 7.
Custom orders may require additional time depending on materials, design, workload, and availability.

4. DEPOSITS AND PAYMENTS
A deposit or full payment may be required before work begins.
Deposits paid toward custom orders are refundable if the buyer cancels before Production Start (as defined in Section 3). Once Production Start has occurred, deposits are non-refundable.
Final payment must be received before the completed knife is shipped or delivered.

5. PRODUCT VARIATIONS
Because each knife is individually handmade, minor variations in dimensions, finish, color, handle material, markings, and other characteristics may occur – for example, blade or handle dimensions varying by a small fraction of an inch from published specifications, or natural variation in the grain or color of handle materials.
These variations are considered part of the handmade nature and character of the product and are not considered defects.
A variation that departs materially from the buyer’s approved specifications, or that affects the knife’s structural integrity or intended function, is addressed under Section 7 (Warranty) rather than under this section.

6. INSPECTION UPON DELIVERY
The buyer must inspect the knife within 72 hours of receipt.
Any damage that appears to have occurred during shipping must be documented, including photographs of the knife and shipping packaging, and reported to T Rose Knives within that same 72-hour period.
This reporting period applies to shipping-damage claims only and does not limit the buyer’s rights under Section 7 (Warranty) for defects unrelated to shipping.

7. WARRANTY
T Rose Knives stands behind the quality and craftsmanship of its work. This is a Limited Warranty for purposes of the Magnuson-Moss Warranty Act, 15 U.S.C. § 2301 et seq.
For a period of one (1) year from the date of delivery, warranty coverage applies to defects in workmanship or materials under normal intended use. Warranty coverage does not include damage caused by misuse, abuse, improper sharpening, modification, neglect, corrosion, accidents, prying, chopping beyond the intended design, or normal wear and tear.
Whether a reported issue falls within a warranty exclusion above will be evaluated against the ordinary, intended use of the specific knife model, as described in T Rose Knives’ published specifications for that model. If a reported issue is confirmed as a covered defect, T Rose Knives will, at its own option, repair or replace the knife; this is the buyer’s exclusive remedy under this warranty.
EXCEPT FOR THE EXPRESS LIMITED WARRANTY ABOVE, T ROSE KNIVES DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY THE LAW GOVERNING THIS AGREEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OF IMPLIED WARRANTIES, SO THIS LIMITATION MAY NOT APPLY IN FULL. THIS WARRANTY GIVES THE BUYER SPECIFIC LEGAL RIGHTS, AND THE BUYER MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

8. SHARPENING AND MAINTENANCE
Knives are precision tools and require proper care and maintenance.
The buyer is responsible for maintaining the knife appropriately, including cleaning, drying, sharpening, and protecting the blade from corrosion when applicable, in accordance with the care instructions provided with the knife or published by T Rose Knives.
High-carbon steels may naturally develop a patina with use. Patina and normal changes in appearance are not considered defects.

9. SHIPPING
Orders will be shipped to the address provided by the buyer.
Risk of loss passes to the buyer upon delivery of the product to the shipping carrier (FOB origin).
T Rose Knives is not responsible for delays, loss, theft, or damage caused by the shipping carrier after the package has been accepted by the carrier, except where otherwise required by law.
Custom orders valued over $300 will be shipped with insurance and signature confirmation. The cost of this insurance and signature confirmation is included in the shipping quote provided to the buyer and is paid by the buyer.
The buyer is responsible for providing an accurate shipping address.

10. OWNERSHIP AND USE
Knives sold by T Rose Knives are intended to be used responsibly and for their intended purpose.
The buyer assumes responsibility for the safe handling, storage, transportation, and use of the knife after delivery.
T Rose Knives is not responsible for injuries, property damage, or other losses resulting from misuse, improper handling, unauthorized modifications, or unlawful use of a knife.
This section addresses the buyer’s responsibility for handling and use of the knife after delivery and does not limit T Rose Knives’ warranty obligations under Section 7 for defects in workmanship or materials.

11. RIGHT TO REFUSE SALE
T Rose Knives reserves the right to refuse or cancel an order when there is reasonable concern regarding the buyer’s age, legal ability to purchase or possess the product, intended unlawful use, fraudulent activity, or violation of these Terms & Conditions.
If T Rose Knives refuses or cancels an order under this section, any payment already made by the buyer will be refunded, except for amounts already expended on materials or production for a custom order at the time of cancellation.

12. CHANGES TO ORDERS
Changes to a custom order may not be possible after Production Start (as defined in Section 3). Any requested change must be submitted in writing and is effective only once confirmed in writing by T Rose Knives. Additional charges resulting from an approved change will be agreed with the buyer in writing before the change is made.

13. ACCEPTANCE OF TERMS
Before completing checkout, the buyer must affirmatively agree to these Terms & Conditions by checking a single confirmation box presented on the order page, stating: “I confirm that I am 18 years of age or older and that I have read and agree to the Terms & Conditions of Sale,” with a direct link to this document. By checking that box and completing the order, the buyer confirms the age requirement in Section 1 and acknowledges that they have read, understood, and agreed to these Terms & Conditions. This confirmation, together with the date, time, and version of the Terms & Conditions then in effect, is retained as part of the order record.
